Regulations

  1. Regulations („Regulations”) define the functionality rules of using the Sanplast online shop, actives with the website adress: www.sanplast.pl named below as „Shop”.
  2. Shop is kept by Sanplast SA with the headquarter in Wymysłowice, Wymysłowice 1, 88-320 Strzelno, registered with the number KRS 0000291835 of the National Court Register kept by  the Disctrict Court in Bydgoszcz XIII Economic Department of the National Court Register, NIP number 557-15-80-536, REGON nr 092901556 („Sanplast)
  3. The Users of the Shop must meet technical requirements of the IT system used by Sanplast SA, i.a. active Internet connection and the installed current Internet browser e.g. Internet Explorer, Firefox, Opera, Safari, Chrome or the other - comparable one - to allow reading of the website content in the computer screen. In some cases, the free Adobe Reader and Adobe Flash Player to view the files on the page can be needed.
  4. The orders for the products offered in the Shop („products” or „product” as the singular) can be submitted by adult person with full legal capacity, a legal person or an organizational unit without legal personality and having the capacity to perform acts in law ("Clients" or "Client" in the singular).
  5. Orders can be placed after registration or omitting registration. In the case of placing an order with the omission of registration, the Client should provide the data enabling the execution of the order. Providing the above data is a condition for the conclusion of the contract with Sanplast.
  6. In connection with the registration, Clients who are adult persons may be required to provide the following personal data: name, address, email address, telephone number.
  7. The User registration is made by correctly filling in the form located on the registration website. The User is required to complete all mandatory fields correctly in order to register in the Shop. By completing the registration form, the User confirms that he has read the Regulations. In connection with registration, the Client:

a) is obliged to provide real data during registration and when changing these data,

b) can have only one account,

c) gives rights to the processing by Sanplast SA the data provided during registration to execute the order,

d) gives rights to the disclosure of data to entities providing courier services, intermediaries in making electronic payments for the purpose of the contract, as well as entities whose list is available at www.sanplast.pl/map/services. (the basis of Article 6 (1) (b) Regulation of the European Parliament and of the Council (EU) 2016/679 27 April 2016);

e) may give rights to the processing by Sanplast SA the data, provided during registration, for marketing purposes (the basis of Article 7 Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016)

d) acknowledges that the provided personal data is subject to the protection of personal data in a manner consistent with applicable regulations,

e) has the right to inspect and correct personal data provided during registration, as well as the right to request their removal.

  1. Personal data are collected by the website administrator, that is, by Sanplast SA, Wymyslowice 1, 88-320 Strzelno, registered with the number KRS 0000291835 of the National Court Register kept by  the Disctrict Court in Bydgoszcz XIII Economic Department of the National Court Register, NIP number 557-15-80-536, REGON nr 092901556
  2. The Clients have the right to withdraw their consent regarding the processing of personal data. The Clients have the right to control the processing of data, including their supplementation, updating, rectification, deletion, as well as the right to limit processing and object to processing. The Client has the right to transfer his data.
  3. For refusal to perform the activities referred to in point 9 above, the Client may complain to the competent supervisory authority.
  4. The Users personal data related with the order executing, are collected by Sanplast by the time of the contract duration, the period of Sanplast  warranty and warranty for sold Products  and for the period necessary for tax and accounting purposes. Personal data processed for marketing purposes will be processed until the date of withdrawal the Client consent.
  5. Sanplast applies appropriate technical and organizational measures to ensure the protection of personal data processed, appropriate to the threats and categories of data protected.
  6. Sanplast ensures that the Clients' personal data will not be made available to any unauthorized entities. The Clients' personal data may be transferred to entities authorized to receive them under applicable law, including relevant authorities.
  7. The Clients' personal data may be entrusted to third parties for purposes related to the execute of the contract concluded with the Client. Sanplast indicates that it will entrust personal data to the following entities: Krajowa Integrator Płatności S.A. and Schenker sp. z o.o.S anplast may entrust personal data to entities whose list can be found at www.sanplast.pl/map/services.
  8. By registering on the Shop website, the User gives right to the processing of the personal data for the purposes of the contract. The ability to process personal data for marketing purposes, and in particular the ability to send commercial information by electronic means, exists after the User consents to such processing.
  9. The Users personal data are collected and processed based on the consent given by the User and valid regulations on personal data protection.
  10. In connection to the Users visits in the Shop and www.sanplast.pl website, a so-called cookie files are placed in his/her computer. These cookie files are read during next visits at the site and allow for the improvement of the website operation.  The User acknowledges that he can change the Internet browser setting in such a way that cookies are not saved. More information can be found on the “Privacy politics” website.
  11. Registration on the Shop website is free of charge.
  12. After placing the order, the Client will receive an e-mail with a message confirming the order.
  13. The Products bought in the Shop are delivered exclusively on the territory of the Republic of Poland. The products are delivered to the Client within 21 days of placing the order. Information on the delivery method and related costs can be found in the Delivery terms tab.
  14. Only the following payment methods are possible and accepted:

  a) cash on delivery at the time of delivery,

  b) online bank transfer via the transferuj.pl service

  1. A limited number of Products is intended for promotional offer and sales. Such orders may be executed on the basis of specific conditions specified by Sanplast.
  2. All prices of Products placed on the Shop's website are given in Polish zlotys and include VAT tax.
  3. The price given for each Product is binding at the time of order placement.
  4. Making to the extent permitted by law, price changes, terms of promotional campaigns or sales does not affect the prices and conditions of sale of Products in orders placed before the effective date of the change in price, terms of promotional campaigns or sales.
  5. Sanplast is not liable for non-delivery or delay in its delivery caused only by an incorrect or inaccurate address provided by the Client.
  6. The Client has the right to lodge a complaint. The rules of complaint for Clients who are consumers can be found below in points 34 - 41 of the Regulations.

 

Additional provisions regarding the sale of Products in the Shop for consumers.


In addition, if the Client is a consumer, i.e. a adult person with full legal capacity making a legal transaction with Sanplast (Buying of Products in the Shop) not directly related to the client's business or professional activity, the following provisions of points 28-41 will apply additionally:
 

  1. Sanplast ensures that at the latest at the moment the Client wishes to be bound by the contract, Sanplast will provide the Client all the information referred to in the Article 12 paragraph 1 of the Act of 30 May 2014. on consumer rights (Dz.U.2014.827).
  2. In accordance to the Article 17 paragraph 1 of the Act of 30 May 2014. on consumer rights (Dz.U.2014.827), immediately before the Client submits the order, Sanplast as the seller will provide the Client all information about the main characteristics of the Products, the total price including taxes, as well as charges for transport, delivery, postal services and other costs in the clear and visible way.
  3. In accordance to the Article 17 paragraph 2 and paragraph 3 of the Act of 30 May 2014. on consumer rights (Dz.U.2014.827), at the time of ordering, the Client will be asked to clearly confirm that he knows that the order entails the obligation to pay. For this purpose, the function used to place an order is additionally marked in an easily legible way with the words "I BUY AND PAY".
  4. In accordance to the Article 21.1 of the Act of May 30, 2014. on consumer rights (Dz.U.2014.827), as a seller, Sanplast will provide the Client confirmation about make the contract by e-mail to the e-mail address provided by the Client. Confirmation will be provided within 24 hours of placing the order.
  5. As a seller, Sanplast undertakes to deliver the ordered Product to the Client in a state free from physical and legal defects.

 

Right of withdrawal

 

  1. In accordance to the Article 27 of the Act of 30 May 2014. on consumer rights (Dz.U.2014.827), the Client may withdraw from the Product purchase contract taken in the Shop without giving a reason within 14 days. Detailed information about the right of withdrawal, including the method and date of its execution, along with the withdrawal form and information about costs of Product returning in case of withdrawal can be found in the Right of Withdrawal tab.

     

Complaint

 

  1. In the ecase of a Product defect, the Client has the right to claim. The complaint for the Product defect can be done  either on the terms of guarantee or on the terms of the warranty. When submitting a complaint, the Client may (but it is not obligatory) use the complaint form.
  2. As a seller, Sanplast is liable to the Client under the warranty for Product physical or legal defects, if the defect is found before the expiry of 2 years from the delivery of the Product to the Client.
  3. Submitting a complaint under the warranty way, according to Client choice, The Client can demand:

  a) removing the defect (repair of the goods),

  b) exchange of the product for one free from defects,

  c) lowering the price,

  d) withdrawal from the contract, if the defect is significant.

  1. In the case of Product defectiveness and notification of remove the defect or replace to the product free of defects  made by the Client under the warranty, the seller is obliged to remove the defect or replace the defective product into free from defects within a reasonable time without undue inconvenience to the Client. However, the Seller may refuse to satisfy the Client's request if it is impossible to bring the defective product into conformity with the contract in a manner chosen by the Client or would require excessive costs in comparison with the second possible way to bring it into compliance with the contract.
  1. In the case of Product defectiveness and submission statement about price reduction or withdrawal from the contract by the Client under the warranty, the seller may disagree with the Client's request and propose that immediately and without undue inconvenience to the Client replace the defective product into free from defects or defects remove. This limitation does not apply if the product has already been replaced or repaired by the Seller or the Seller has not satisfied the obligation to exchange the product for one free of defects or to remove the defect.
  2. Instead of removing the Product defect (repair) the Client may demand Product replacement for Product free from defects, or demand removal of the defect (repair) instead of replacing the Product, unless bringing the Product to compliance with the contract in a manner chosen by the Client is impossible or would require excessive costs in comparison with the method proposed by the Seller. When assessing the excess of costs, the value of the product free of defects, the type and significance of the defect is taken into account, and the inconvenience to which the customer would otherwise be satisfied is taken into account.
  3. f the Products have been installed, theClient may request the seller to dismantle and re-install after replacing the product free of defects or to remove the defect. If the seller does not fulfill this obligation, the Client is entitled to carry out these activities at the expense and risk of the seller. However, if the Client requests dismantling and re-installing the Products, the Client is obliged to pay some of the related costs that exceed the price of the Products sold. The Client may request the seller to pay part of the costs of disassembly and reassembly up to the price of the Products sold.
  4. If Sanplast, as a seller, fails to respond within 14 days to the Client's request regarding:

  a) the replacing the Products, or

  b) removing the defect (repair) or

  c) reduction of the price with specification of the amount by which the price is to be reduced,

it is considered that he considered the client's request justified.

  

Information about the possibility of using out-of-court complaint handling and redress.
 

  1. In the case of a dispute related to the purchase of Products by the Client, regardless of the right to refer the matter to a court of law, the Client may use other means of resolving the dispute at the pre-litigation stage. In particular, the Client may use the institution of mediation at the provincial inspectorates of the Trade Inspection. This mediation is conducted by the employees of the voivodeship inspectorates of the Trade Inspection at the request of the client or ex officio after the complaint has been exhausted. The mediator (employee of the Voivodship Inspectorate of Trade Inspection) on the basis of the principle of impartiality and in principle costless (possible costs in the case of the appraisers' appointment) helps in solving the dispute. Mediation is voluntary.

In addition, the Client may use the assistance of institutions and organizations dealing with consumer rights such as:

 a) poviat Client advocate,

 b) Consumer Federation,

 c) Association of Polish Consumers.

In addition, the Client may use the intermediation of the ODR platform operating in the EU at https://webgate.ec.europa.eu/odr

  1. Each user is obliged to use the Shop's website in accordance with the law in force in the Republic of Poland, in accordance with the rules of social coexistence, in accordance with these Regulations.
  2. On the Shop's website, it is in particular prohibited to:

 a) any actions that may hinder or disrupt the website's operation and use of the website services in a way that is inconvenient for other users,

 b) providing false personal data, in particular it is unacceptable to create users who do not exist in reality and to provide personal data of other people as their own personal data, use other users' accounts or share their own accounts with other people,

 c) any actions that violate the privacy and reputation of other users,

 d) placing and transmitting through it content and materials that are contrary to applicable law and the rules of social conduct, in particular, vulgar, obscene and pornographic content, content commonly considered offensive or violating the personal rights of others,

 e) any actions consisting in using any function of the website to send and publish unsolicited commercial information, conduct arbitrary commercial, advertising or promotional activities,

 f) any actions violating the rights of other entities, in violation of copyrights.

  1. These Regulations are effective from December 25, 2014. Sanplast reserves the right to change the regulations with effect for the future. The changes come into force at the earliest 7 days after their announcement on the website and do not apply to orders placed before the changes were introduced.
  2. The User's violation of the Regulations entitles Sanplast to take the legal steps provided for, in particular: suspension or deletion of such user's account or notification of breach of authorized services and bodies.
